Terms of service

These Terms of Service (the “Terms”) are a binding agreement between you and GMLABS, a Maryland limited liability company (“GMLABS”, “we”, “us” or “our”). They govern your use of godmodealgo.com (the “Site”) and your purchase and use of GODMODE V4 — Insider Edition, including the TradingView indicator source code, signals, screener, dashboard, guides, updates and support we provide (together, the “Product”).

By visiting the Site, creating an order, or downloading, copying or using the Product, you agree to these Terms and to the documents they incorporate: our License Agreement, Refund Policy, Privacy Policy, Delivery Policy, Risk Disclosure, Financial Disclaimer and Earnings & Testimonial Disclaimer. If you do not agree, do not use the Site or the Product.

Important: GODMODE is a technical analysis tool, not financial advice. GMLABS is not a registered investment adviser, broker-dealer, commodity trading advisor or financial planner. Trading stocks, options, futures, forex and cryptocurrencies involves substantial risk of loss and is not suitable for everyone. You can lose some or all of the money you trade. Signals can be wrong. Past or simulated results do not guarantee future results.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and legally able to enter into contracts to buy or use the Product. You are responsible for making sure that using trading tools, and trading the markets you choose, is legal where you live.

2. What the Product is

The Product is a technical analysis indicator written for the TradingView platform, delivered to you as source code that you copy into TradingView’s Pine Editor yourself, together with setup guides and related materials. It plots visual markers (such as “BUY” and “SELL” labels, trend colouring, levels and screener results) based on mathematical calculations applied to historical and current price data.

  • It is a tool, not a service that trades for you. The Product does not place trades, connect to your brokerage account, manage money or make decisions for you. Every trading decision is yours.
  • “Insider” is a brand name. “Insider Edition”, “Insider Knowledge”, “Insider Screener” and similar names are product branding only. The Product does not use, contain or provide material non-public information, and nothing on the Site invites you to trade on such information.
  • “Signals”, “buy”, “sell”, “confidence” and similar words describe what the indicator draws on a chart according to its formulas. They are not recommendations to buy or sell any security, contract or asset, and they are not personalised to your situation.
  • Charts, animations and screenshots on the Site are illustrative. Where the Site shows example charts, before/after comparisons, signal previews, screener tables, confidence percentages, entries, stops or targets, these are simulated or selected examples for demonstration and are not a record of actual trading.

3. Accounts and third-party platforms

To use the Product you need your own TradingView account (free or paid) and, if you trade, your own brokerage or exchange account. TradingView, brokers, exchanges and data providers are independent third parties. We do not control them and are not responsible for their availability, pricing, data accuracy, rules, plan limits, outages, or changes to the Pine Script language or platform that may affect how the Product works. You must follow TradingView’s own terms of use.

4. Orders, pricing and payment

  • Prices are shown in U.S. dollars unless stated otherwise and are charged once per purchase (a one-time payment, not a subscription) unless the checkout clearly says otherwise. Applicable taxes may be added at checkout.
  • Payments are processed through Shopify’s checkout and its payment partners. We do not see or store your full card number.
  • Any “compare at”, crossed-out or “regular” price, countdown timer or limited-time offer reflects our own pricing decisions and may change at any time. We may change prices, offers, features and availability without notice; changes do not affect orders already paid for.
  • We may refuse or cancel any order (for example, suspected fraud, pricing errors or a breach of these Terms). If we cancel a paid order before delivery, we will refund it.

5. Delivery

The Product is digital; nothing is shipped. After payment is confirmed, the source code and setup materials are made available to you electronically as described in our Delivery Policy. You are responsible for following the setup guide and adding the code to TradingView yourself. Delivery is complete once the Product is made available to you.

6. License — what you may and may not do

When you pay for the Product, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use it, as set out in full in our License Agreement. In short: you may use it on your own TradingView account for your own trading. You may not share, resell, sublicense, publish (including publishing it as a public or invite-only script on TradingView), give away, rebrand or redistribute the code or any modified version of it. We own the Product and all intellectual property in it; you are buying a license, not ownership.

7. “Unlimited”, “forever” and lifetime wording

When the Site says “Unlimited Signals Forever”, “lifetime” or similar, it means you may keep using the version of the code you received for as long as you comply with these Terms, with no recurring fee from us. It does not promise that TradingView or any data feed will remain available or unchanged, that the Product will remain compatible with future platform changes, that we will keep releasing updates, or that the business will operate indefinitely. Updates, the dashboard and support are provided at our discretion.

8. Support

We offer reasonable support by email for setup questions about the Product. “Priority support” means buyers of the Product are handled ahead of general enquiries; it is not a guaranteed response time. Support never includes personalised investment advice or opinions on what you should trade.

9. Refunds

Because the Product is delivered as source code that cannot be returned, all sales are final once the Product has been delivered, except as described in our Refund Policy.

10. Chargebacks

If you believe a charge is wrong, please contact us first at thetest128i@gmail.com so we can fix it. If you open a chargeback or payment dispute for a delivered order without first contacting us, we may revoke your license, deny future purchases and provide evidence of delivery and your acceptance of these Terms to the payment provider.

11. No financial advice; risk

All content on the Site and in the Product, including signals, guides, emails, social posts, testimonials and support replies, is for general educational and informational purposes only. It is not investment, financial, tax or legal advice and is not an offer or solicitation to buy or sell anything. You are solely responsible for your trades and their results. 12. Testimonials and results

Reviews, ratings and testimonials reflect individual experiences and opinions. They are not typical and are not a promise of results. See our Earnings & Testimonial Disclaimer.

13. Acceptable use of the Site

You agree not to: break the law; infringe anyone’s rights; attempt to gain unauthorised access to the Site or our systems; scrape, copy or mirror the Site; upload malware; interfere with the Site’s operation; impersonate anyone; or use the Site or Product to give paid trading advice or run a signal service for others.

14. Intellectual property

The Site, the Product, the GODMODE and GMLABS names and logos, designs, text, graphics, code and all other content are owned by or licensed to GMLABS and are protected by copyright, trademark and other laws. Nothing in these Terms transfers ownership to you. TradingView is a trademark of its respective owner; we are not affiliated with, endorsed by or sponsored by TradingView.

15. Disclaimer of warranties

THE SITE AND THE PRODUCT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS. TO THE FULLEST EXTENT PERMITTED BY LAW, GMLABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE PRODUCT WILL BE PROFITABLE, ACCURATE, ERROR-FREE, “NON-REPAINTING” UNDER EVERY CONDITION, UNINTERRUPTED, COMPATIBLE WITH EVERY TRADINGVIEW PLAN OR FUTURE PLATFORM VERSION, OR THAT ANY SIGNAL WILL RESULT IN A PROFITABLE TRADE.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GMLABS AND ITS OWNERS, MEMBERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY TRADING OR INVESTMENT LOSSES, LOST PROFITS, LOST DATA, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SITE OR THE PRODUCT, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR THE PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

17. Indemnity

You agree to indemnify and hold harmless GMLABS and its owners, members, employees and contractors from any claims, losses, liabilities and expenses (including reasonable attorneys’ fees) arising from your use of the Product, your trading activity, your breach of these Terms or the License Agreement, or your violation of any law or third-party right.

18. Termination

We may suspend or terminate your license and access to the Site, updates or support if you breach these Terms or the License Agreement, commit fraud, or file an unfounded chargeback. On termination you must stop using and delete all copies of the code. Sections that by their nature should survive (including licensing restrictions, disclaimers, limitation of liability, indemnity and governing law) survive termination.

19. Governing law and disputes

These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-laws rules. Before filing any claim, you agree to contact us at thetest128i@gmail.com and try in good faith to resolve the dispute informally for at least 30 days. Any claim that is not resolved informally must be brought in the state or federal courts located in Maryland, and you consent to their jurisdiction, except that either party may bring an individual claim in small-claims court where it qualifies. To the extent permitted by law, claims must be brought individually and not as part of a class or representative action.

20. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above shows when they last changed. Changes apply from the date they are posted; continued use of the Site or Product after that means you accept them. The version in effect when you purchased governs that purchase unless the law requires otherwise.

21. General

These Terms and the documents they reference are the entire agreement between you and us about the Site and Product. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a sale or reorganisation of our business. Nothing in these Terms creates a partnership, agency or fiduciary relationship.
